Highly Skilled Knowledge Migrant
Since October 2004 Dutch employers are permitted to hire non-EU nationals without work permits if the following requirements are met:
- The employer/company has registered at the Integration & Naturalisation authorities (IND) for the Highly Skilled Migrant Program; and
- To be considered as a Highly Skilled Migrant the applicant is required to earn an annual salary of at least € 50.183 if he or she is over 30 years of age. If the applicant is under 30 the required annual salary is € 36.800.-.
Once a contract has been signed, the regular rules regarding issuance of a residence permit apply such as having a valid passport, no criminal record and health insurance.
The residence permit of a highly skilled knowledge migrant is granted for the length of the employment contract, up to a maximum of five years, assuming the migrant’s passport is valid for that duration.
Partners of highly skilled knowledge migrants can work without needing a work permit, providing they apply and are granted a residence permit which will be valid for one year. Their residence permit should be timely extended if the Knowledge Migrant employee will stay longer than 1one year. The residence permit of the children will have the same term as the residence permit of the highly skilled migrant.
USA nationals and some other non- EU applicants who do not require an entry visa (MVV) to enter the Netherlands, may start working as a highly skilled knowledge migrant only once their residence permit application is approved. Foreigners who require an MVV can start work immediately upon registration with the IND since their eligibility for a residence permit was determined by the MVV process in their home country.
